Understanding opposition

Trademark opposition: safeguard your brand legally

A trademark opposition is a formal objection filed by a third party after a trademark application is published, and before it is registered. It can delay your registration or stop it altogether if it is not handled correctly and on time.

Opposition works both ways. If a new application is too close to your brand, you can oppose it before it is registered. If your own application is opposed, you must defend it with a well-argued counter-statement and evidence. At AnalystIP, we handle both sides with careful legal analysis, evidence gathering and strong drafting.

Act fast: deadlines are strict

Opposition periods and response deadlines are fixed by law and vary from country to country.

In India, for example, a notice of opposition must be filed within four months of the mark being advertised in the Trade Marks Journal. An applicant who does not file a counter-statement within two months of receiving the notice has the application treated as abandoned.

Grounds

Common grounds for trademark opposition

Most oppositions rely on one or more of these grounds. Knowing which apply is the first step to a strong opposition or defence.

Similarity and likelihood of confusion

The mark is identical or confusingly similar to an earlier mark for related goods or services.

Bad faith

The application was filed dishonestly or without a genuine intention to use the mark.

Descriptive or not distinctive

The mark simply describes the goods or services, or cannot identify a single business.

Prior rights

The mark conflicts with earlier rights such as prior use, copyright or a trade name.

Deceptive or misleading

The mark is likely to deceive the public about the nature, quality or origin of the goods.

Prohibited names and symbols

The mark uses religious, national or other names and emblems that the law does not allow.

FAQ

Frequently asked questions

Who can file a trademark opposition?
In most countries, including India, any person can oppose a published trademark application. You do not need to own a registered trademark yourself, although earlier rights such as a prior registration, prior use or a well-known reputation make an opposition much stronger.
How long do I have to file an opposition?
It depends on the country. In India the period is four months from advertisement in the Trade Marks Journal. In the United States it is 30 days from publication, which can be extended. At the EU Intellectual Property Office it is three months from publication. Contact us as soon as you spot a conflicting mark so the deadline is not missed.
What happens if I don't respond to an opposition?
In many countries, including India, an application is treated as abandoned if the applicant does not file a counter-statement within the time allowed. That is why it is important to act as soon as you receive a notice of opposition.
How long does an opposition take?
Timelines vary widely by country and by case. A matter that settles early can close within a few months, while a fully contested opposition with evidence and hearings can take considerably longer. We track every step and keep you informed throughout.
Can an opposition be settled without a hearing?
Yes. Many oppositions end with a negotiated outcome, such as a coexistence agreement, a limitation of the goods or services, or withdrawal by one party. Where it is in your interest, we advise on and negotiate an amicable settlement.
What do you need from me to get started?
The trademark application number, the country, a copy of the notice of opposition if you have received one, and a short background of the conflict. Use the form at the top of this page and our team will review your case.
